Personal Banker Recovered $38,000 in Unpaid Overtime Wages and Retaliatory Termination

A personal banker at a local bank recovered $38,000 for unpaid overtime wages and retaliation damages. In this case, the client worked more than 40 hours in the workweek and the employer failed to compensate its personal banker(s) for their overtime in violation of the Fair Labor Standards Act (FLSA). When the client raised the issue of her and a fellow coworker’s unpaid overtime wages to her supervisor, the supervisor became hostile towards her. In standing up for the rights of her and her fellow coworker, the employer’s hostile treatment was retaliatory in nature. Shortly after raising the issue of unpaid overtime, the client was terminated for an alleged minor violation of company policy, something that was done by most employees and always tolerated by the employer. Thus, the reason for termination was false (or pretextual) and was absolutely the result of the client’s overtime complaint. If you have worked over 40 hours in the workweek and believe that you are entitled to overtime compensation, or if you complained about receiving proper wages and were terminated or reprimanded, call wage and hour attorney Robert S. Norell for a free case evaluation.
