Employment Case Evaluations and Consultations
I have developed a particular way that I handle employment matters. Based on my 30+ years of experience advising thousands of workers and employers about their rights in the workplace, I use a process that separates a free case evaluation from a paid consultation so that I can be as efficient and effective as possible.
Free Case Evaluations (Initial Screening Process)
I do provide free case evaluations. A case evaluation is not a consultation and does not include legal advice.
When you call my office, you will first speak with my intake clerk and provide general information about your situation. Once that information is received, it is submitted to me for review. I will evaluate the basic facts to determine whether there may be a viable legal claim and whether I am in a position to assist.
After my review, either my intake clerk will call you back or I may contact you directly. Depending on my schedule, this can take anywhere from a few minutes to up to 24 hours.
The purpose of a case evaluation is to determine whether there is a potential case. It is not an opportunity for detailed discussion, document review, or legal strategy.
Consultations (Legal Advice and Strategy)
A consultation is where I listen, review documents, and provide legal advice tailored to your specific situation. Consultations are billed on an hourly basis, with a minimum one-hour engagement.
If you would like to bypass the intake process and speak with me directly, you may schedule a consultation. A typical consultation will involve time spent reviewing your documents in advance, followed by a phone call to discuss your situation in detail.
During a consultation, I will analyze the facts, explain your rights and options, identify potential claims or defenses, and provide practical guidance on next steps.
Why I Charge for Consultations
I get a lot of calls from both employers and employees who want to ask “just one question” and promise that “it will only take a minute.” In my experience, there is no such thing as one question. One question turns into several, and meaningful answers require context, analysis, and careful consideration.
If I took every call and answered every “quick question” for free, I would not have time to properly represent my clients. If your issue truly is simple, you likely do not need an attorney, or a quick online search may point you in the right direction. If you are seeking actual legal advice, that is what a consultation is for.
Florida Severance Agreement Review
Many employees come to me to review severance agreements. This is handled on an hourly basis as part of a consultation.
It is not enough to simply read the severance agreement. Most agreements contain broad general releases, meaning you may be giving up legal claims in exchange for the compensation being offered. A proper review requires looking at both the agreement and the facts and circumstances that led to your termination.
During a consultation, I will evaluate potential claims, assess the value of those claims, and compare that value against what is being offered. In many cases, I can review the agreement and the surrounding circumstances within a single consultation and provide practical advice on next steps, whether that involves negotiating improved terms or considering other courses of action.
Non-Compete and Restrictive Covenant Review
I also review non-compete agreements and other restrictive covenants on an hourly basis.
These agreements can significantly impact your ability to work in your field. A proper analysis requires reviewing the language of the agreement, the scope of the restrictions, and the surrounding facts, including your role, industry, and geographic considerations.
During a consultation, I will advise you on enforceability, risk, and practical strategies for moving forward.
Advice for Florida Employers
I regularly advise employers on employee discipline and termination decisions, wage and hour compliance, EEOC investigations and Department of Labor investigations and audits.
These issues are often time-sensitive and require careful planning. During a consultation, I can help evaluate risk, ensure compliance with federal and Florida law, and develop strategies to address problem employees or avoid potential claims before they arise.
Efficiency and Approach
All consultations and document reviews are handled on an hourly basis, with a minimum one-hour time commitment. I make every effort to be efficient while still providing thorough, practical advice.
In many situations, a single one-hour consultation is enough to give you the information you need to make an informed decision and move forward. Of course, cases and situations vary, but most consultations can be completed within one single one-hour engagement.
