Customer Service Manager at Cosmetic Company Recovered $15,000 in Unpaid Overtime Wages

A customer service manager at a local cosmetic company recovered $15,000 in unpaid overtime wages. In this case, the client was paid on salary and worked more than 40 hours per week, but did not receive any overtime compensation. The Fair Labor Standards Act requires non-exempt employees to be paid time and one half their regular hourly rate for all hours worked more than 40 per workweek. Although the client’s job title contained the word “manager,” she did not manage or supervise employees, which is required if an employer wants to claim that an employee is exempt from overtime. By failing to compensate the client for her overtime, the employer violated the provisions of the FLSA entitling the client to recovery of such amounts in addition to liquidated damages (double damages) and attorney’s costs and fees. If you have worked over 40 hours in the workweek and believe that you are entitled to overtime compensation because you have been misclassified as exempt, call wage and hour attorney Robert S. Norell for a free case evaluation.
