Before you can file a lawsuit for unpaid minimum wages under the Florida Minimum Wage Act, you must give the employer at least 15-days written notice to pay the minimum wages owed. In order to do this, you must notify the employer, in writing, of your intent to file suit. The notice must identify the minimum wage that you claim is owed as well as the actual or estimated work dates and hours for which payment is sought, and the total amount of alleged unpaid wages through the date of the notice. We recommend that you send it via certified mail, return receipt requested. If your employer still refuses to pay you after you have sent the written notice, call us and we will be happy to discuss your case and see if we can help you recover your unpaid wages.
